The booking of a holiday property described in these conditions is a legally binding agreement for hiring the property for a specified period. These booking conditions contain rights and obligations to which you must have read and agreed to before making your booking. |

| 1.
Definitions
In these conditions ‘The Agents’ shall mean Berghamns stugor AB, acting as agents on behalf of the legal owner(s) of the holiday property, herein referred to as ‘The Owner(s)’. ‘The Holiday Property’ shall mean the property owned by ‘The Owner(s)', to be marketed and let through ‘The Agents’. ‘The Customer’ shall mean the individual or group of individuals who make the booking. ‘The Customer’ acts on behalf of and is responsible for all persons in his/her party. 2. Contract The contract shall be between ‘The Customer’ and ‘The Owner(s)’, acting through ‘The Agents’, but will not exist until a booking has been made and a booking confirmation has been sent to ‘The Customer’ and ‘The Owner(s)’ by ‘The Agents’. 3. The Holiday Cost (a). The rental price usually includes self-catering accommodation, all furniture and fittings, cutlery and dishes, use of sauna, rowing boat, barbecue hut and garden games, electricity, gas, water, pillows, blankets, mattresses, holiday advice, maps and/or driving instructions in English, Swedish and Finnish. (b). The rental price does not usually include transportation, meals, washing-up liquid, soap, toilet paper, kitchen roll, excursions and activities, bed linen and towels or cleaning of 'The Holiday Property' at the end of the rental period. (c). It is often possible to rent bed linen (and towels) for 10 Euro per person, or to arrange the final cleaning of 'The Holiday Property' to be done on 'The Customer's' behalf. The cleaning charge is clearly stated in each individual cabin description, where this service is available. Bed linen and cleaning must be arranged and paid for in full before the beginning of the rental period. (d). 'The Customers' are asked to refer to individual cabin descriptions for exact details about what is included and excluded in each individual 'Holiday Property'. (e). ‘The Agents’ reserve the right to alter prices displayed on the Berghamns stugor AB (www.ikp-safety.com ) in cooperation with ©Finland Seaside Holidays (www.finlandseaside.com )websites, due to special offers or promotions, errors, omissions, exchange rate fluctuations, increased banking charges, changes in VAT or for any other reason. Prices for confirmed bookings however are always honoured. 4. Booking (a) A booking can be made online using the online booking form that can be submitted electronically. If the booking is made online, ‘The Customer’ must read and agree to these Booking Conditions before submitting the booking form. A signed booking form is required if the booking is made by telephone, fax or email. The booking form in pdf-format can be downloaded from the website for offline completion. (b) Once the booking form has been received, 'The Agents' contact 'The Owner(s)' to book 'The Holiday Property' and to confirm the up to date availability and rental costs. If the requested rental period is still available and the rental cost has not changed, 'The Agents' will confirm the booking details and all costs to 'The Customer' as soon as possible, usually within 24 hrs. If any booking details such as the availability or rental cost have changed from those detailed on the website, 'The Agents' will inform 'The Customer' about the changes as soon as possible. 'The Customer' may withdraw from the booking, or if possible, agree to an alternative letting period or the amended costs. (c) After the booking has been agreed, 'The Customer' must state how he or she wants to pay for the booking. All bookings are confirmed in writing by email or post only once the payment has been successfully cleared in full. (d) 'The Agents' will send 'The Customer' the name and address of 'The Owner', including details of from who and where the keys to the property can be collected, six weeks prior to the commencement of the letting period. Driving instructions to 'The Holiday Property' in English will also be provided at this time. 'The Customer' is requested to inform 'The Agents' of their expected arrival time at the agreed meeting point, in order that 'The Agents' can liaise as necessary with 'The Owners' to arrange the meeting. 5. Payment (a) Payment for the total rental cost is due once a booking has been agreed. We accept payments by bank transfer. Euro bank transfers are accepted. (b) If the booking is paid by a cheque, it should be made payable to Berghamns stugor AB. The cheque must be with 'The Agents' no later than 6 working days after the booking has been agreed. 'The Agents' will confirm the booking to 'The Customer' once the funds have successfully cleared. (c) If the booking is paid by using a bank transfer, the money must arrive to 'The Agents' no later than 6 working days after the booking has been agreed. 'The Agents' will confirm the booking to 'The Customer' once the funds have successfully cleared. 6. Amendments to Booking (a). If ‘The Customer’ wishes to amend a confirmed booking, for example to change to a property of different size or location, this is acceptable, providing another suitable property is available and there is still more than six weeks to the commencement of the letting period. If an alternative property can be found, ‘The Customer’ must pay the difference or be entitled to a refund depending on the rental cost of the alternative accommodation. All amendments are subject to a fixed one-off fee of 30 Euro per booking. (b). If ‘The Customer’ wishes to change the dates of a confirmed letting period, this is acceptable, providing the property is available during the requested period and there is still more than six weeks to the commencement of the rental period. Alternatively ‘The Customer’ can transfer the booking to another property. If the alternative rental period is of a different cost, for example due to seasonal variation, or if the alternative property has a different rental price, ‘The Customer’ must pay the difference or be entitled to a refund depending on the cost of the revised booking. All amendments are subject to a fixed one-off fee of 30.00 Euro per booking. 7. Cancellation (a). If ‘The Customer’ cancels the booking more than 6 weeks before the start of the rental period, he/she will be entitled to a refund of the rental cost, less a 50 Euro cancellation fee. The refund will be paid by Berghamns stugor AB cheque. (b). If ‘The Customer’ cancels less than 2 weeks (to 7 days) before the start of the rental period, for whatever reason, regrettably only 25 % of the rental price can be refunded (after the cottage owner has taken 25 % of the price from the deposit). 'The Agents' therefore strongly advise ‘The Customer’ to take out adequate holiday insurance cover for any eventualities. Cancellation less than 7 days before the start of the rental period, for whatever reason, regrettably only 50 % of the rental price can be refunded (after the cottage owner has taken 50 % of the price from the deposit). 'The Agents' therefore strongly advise ‘The Customer’ to take out adequate holiday insurance cover for any eventualities. (c). If ‘The Customer’ cuts the rental period short and leaves early and ‘The Owner(s)’ is/are not in breach of their obligations, this is treated as a cancellation and ‘The Customer’ is not entitled to a refund or compensation. 8. Delayed Arrival or Departure to/from ‘The Holiday Property’ (a) Neither ‘The Agents’ nor ‘Owner(s)’ will accept liability for any claim arising out of delayed arrival to 'The Holiday Property' due to delayed or cancelled flights or other transportation problems. (b) Any property occupied through Berghamns stugor AB is strictly on the basis that the accommodation is for holiday use only, and that no right to remain in the accommodation exists by ‘The Customer’ or any person allowed into the property by him/her after the agreed rental period has expired. ‘The Customer’ will be held liable for any costs incurred through any delayed departure. 9. Customer Obligations ‘The Customer’ agrees: - (a). To pay for any losses or damages to ‘The Holiday Property’ (including all associated amenities such as garden, outbuildings, equipment, furniture and household goods), however caused (reasonable wear and tear excluded). (b). To keep ‘The Holiday Property’ and all furniture, fittings and effects, in or on the property, in the same state of repair and condition as at the commencement of the holiday, and must also leave ‘The Holiday Property’ in the same state of cleanliness and general order in which it was found. ‘The Owner(s)’ will be entitled to make an additional charge to ‘The Customer’, if 'The Holiday Property' has been left uncleaned and the final cleaning has not been arranged to be done on 'The Customer's' behalf in advance. (c). To permit ‘The Owner(s)’ reasonable access to examine any matter of complaint raised during the letting period and to attend to any resulting repair or rectification or other urgent maintenance. 10. Use of Amenities ‘The Owner(s)’ is/are obliged to keep the property and all associated amenities in good and safe condition, generally and in accordance with all relevant Finnish law and legislation regarding safety in rented holiday properties. ‘The Customer’ and all members of the party are to take due care and act responsibly, when using ‘The Holiday Property’ and all associated amenities, including sauna, rowing and motor boats, fireplace, garden games etc. ‘The Agents’ will act purely as an intermediate between ‘The Owner’ and ‘The Customer’ and cannot be held liable for any act, neglect or default on the part of ‘The Owner’ or any other person, that has resulted in an accident, damage, loss, injury, expense or inconvenience. All matters outside the control of 'The Agents' must be taken up with 'The Owners' directly. 11. General Conditions (a). The person making the booking is responsible for the property and ensuring that all members of the party observe all aspects of their obligations and respect the rules of ‘The Owner(s)’. (b). To comply with ‘The Owner(s)’ insurance requirements, only the maximum number of persons stated in the holiday property description may occupy the property. If the stated number of persons are exceeded, ‘The Owner(s)’ is/are entitled to refuse entry and this will be treated as a cancellation by ‘The Customer’ and Condition 7 (c) will apply. (c). ‘The Customer’ is not to share the property with anyone not nominated in the Booking Form, or listed as a member of the party, or to sublet the property or assign the booking to anyone else, without the prior written agreement of ‘The Agents’. Should ‘The Customer’ breach this clause, ‘The Owner(s)/Agents’ reserve the right to terminate the agreement immediately without refund or compensation. (d). Under no circumstances can the booked holiday period be extended beyond the initial booking period except by the prior written agreement of ‘The Agents’. (e). ‘The Owner(s)’ is/are entitled to ask ‘The Customer’ or any member of ‘The Customer’s’ party to leave ‘The Holiday Property’, without refund of monies paid, if in the reasonable opinion of ‘The Owner(s)’ the behaviour of ‘The Customer’ or members of his/her party is unacceptable. They must observe ‘The Owner(s)’ rules at all times, giving ‘The Owner(s)’ the right to inspect the property during the holiday if considered necessary. (f). Pets are permitted only in those properties, that specifically state that pets are allowed. If a pet is taken to a property where pets are excluded, or the stated number/size of pets is exceeded, ‘The Owner(s)’ is/are entitled to refuse entry or demand that ‘The Customer’ leaves ‘The Holiday Property’ and this will be treated as a cancellation by ‘The Customer’ and Condition 7 (c) will apply. (g). If for reasons beyond the control of ‘The Owner(s)’ or ‘The Agents’ a property is not available on the date booked, due to fire, floods or other force majeure, ‘The Agents’ will endeavour to offer alternative accommodation of a similar type and standard and at the same cost as that originally requested by ‘The Customer’. Should the alternative property offered be of a higher price 'The Agents' reserve the right to charge the difference. If the alternative accommodation is not acceptable to ‘The Customer’, or no alternative accommodation can be found, ‘The Agents’ will refund in full all monies paid and be under no other liability. 12. Complaints Any complaints regarding the condition of ‘The Holiday Property’ or the facilities available must be taken up in the first instance with ‘The Owner(s)’ immediately, so that any necessary action can be taken. If satisfaction is not received ‘The Customer’ is to contact ‘The Agents’ as soon as possible, but preferably within the rental period. ‘The Agents’ will then liaise with ‘The Owner(s)’ and try to rectify the complaint on behalf of ‘The Customer’, although ‘The Agents’ cannot accept responsibility for matters beyond their control. 13. Discrepancies In the event of any discrepancy between these Booking Conditions and the contents of the Berghamns stugor AB website, these Booking Conditions shall prevail. Whilst ‘The Agents’ take all reasonable steps to ensure the accurate reproduction of text/illustrations, it cannot accept responsibility for false or inaccurate descriptions of the property provided by ‘The Owner(s)’, although ‘The Owner(s)’ is/are legally bound to provide ‘The Agents’ with an accurate, truthful and current description of the property. ‘The Customer’ must accept that minor differences between the text and photograph/illustration and the actual property may arise. All distances are approximate and facilities may be altered or withdrawn for reasons not within ‘The Agents/Owner(s)’ control and responsibility cannot be accepted or compensation considered. All statements made by ‘The Agents’ are made in good faith and are based on personal visits to the properties (where applicable) and information and photos provided by ‘The Owner(s)’. 14. Disclaimer The links on ‘The Agent’s’ website are purely for the purposes of offering ‘The Customer’ free advice and information about travelling to, from and within Finland, or activities and attractions available in Finland and do not form part of the service or product offered by ‘The Agents’. The ‘Agents’ are not responsible for the contents or quality of any website reached via a link from www.ikp-safety.com , nor do they take any responsibility for the services or products provided by any such parties. 15. Law & Jurisdiction Finnish law and jurisdiction will apply for the holiday booking and all issues related to booking procedures, including confirmations, cancellations, refunds and booking amendments. ©Berghamns stugor AB.
